Till kravställaren
Bara krav som är relevanta i förhållande till de bekämpningsmedel som är
aktuella ska tas med i anbudsförfrågan. Ta bort allt annat.
Alla krav i del A är lagkrav, förutom 1 a och 2a.
Kraven i del B är ej lagkrav, då biocider i varor inte regleras på samma sätt som
kemiska eller biologiska produkter som innehåller/utgör biocider.
Bekämpningsmedel delas in i biocidprodukter och växtskyddsmedel. I Sverige
gäller som huvudregel att alla biocidprodukter och växtskyddsmedel måste vara
godkända för att få släppas ut på den svenska marknaden. I dagsläget är dock
vissa biocidprodukter undantagna kravet på godkännande. Kravet på
godkännande gäller dock inte för bekämpningsmedel i varor. För utförligare

Modulen kan användas för kemiska eller biologiska produkter som
innehåller/utgör bekämpningsmedel alternativt varor som innehåller biocider,
(en typ av bekämpningsmedel) t ex genom impregnering. För att underlätta för
kravställaren har modulen delats upp i två olika delar (del A och del B), då
bekämpningsmedel i varor inte är reglerade på samma sätt som kemiska eller
biologiska produkter som innehåller/utgör bekämpningsmedel. För krav på
biocider i textila material hänvisas till modulen ”Textil”.
Information om krav A.3: Enligt lagstiftningen ska säkerhetsdatablad lämnas
senast vid första leverans av den kemiska produkten. Det är dock möjligt att
kräva att säkerhetsdatablad ska skickas vid anbudsinfodran eller senast X
månader innan leverans av bekämpningsmedlet. Om anbudsförfrågan kräver
tillhandahållande av säkerhetsdatablad senast någon tidsperiod före leverans, så

måste motsvarande fördröjning av leveransen av den kemiska produkten
medges vid beställning.
Förutom dessa krav ska leverantörens arbete inom kemiområdet kravställas
genom att FMV klausulen ”Kemiska ämnen/produkter/varor” används i de
kommersiella villkoren för upphandlingen.
A. Requirements on chemical or biological
products, which contain/represent pesticides
1. Biocidal products
a. The supplier shall list all the biocidal products that are being procured.

b. The trade name of the biocidal product, chemical name and identification
number (CAS no or equivalent) for the active substances shall be specified in
the list.
c. The biocidal products being procured shall be authorised by the Swedish
Chemicals Agency (KemI) and thereby have a registration number in the
KemI´s pesticides register. The requirement does not apply to biocidal
products that are excluded the requirement for approval.
d. If a biocidal product without authorisation according to the above procedure
is procured, the active ingredient shall be on the EU´s work programme on
existing active substances (Regulation (EC) no 1451/2007).

2. Plant protection products
a. The supplier shall list all the plant protection products being procured.
b. The trade name of the plant protection product, chemical name and
identification number (CAS no or equivalent) for the active substances shall be
included in the list.
c. The plant protection products used shall be authorised by the Swedish
Chemicals Agency (KemI) and thereby have a registration number in the
KemI´s pesticides register.
d. In addition, the choice of plant protection product shall be in line with the
Swedish Environmental Agency’s code of statutes on the application of
chemical pesticides (SNFS) no 2/1997.
